US Judge Mandates Freedom of Abrego Garcia from ICE Custody

A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to face human smuggling charges, he was held in immigration custody.

In her order, the court noted that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal proceedings center on disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in Tennessee.
